Yuze Cao and AusCarClub - Court action

AusCarClub Pty Ltd (ACN: 602 688 335) and its director Yuze Cao have been restrained from engaging in unlicensed motor car trading until further order of the Melbourne Magistrates’ Court, under an interim injunction.

Consumer Affairs Victoria has taken action against AusCarClub and Mr Cao, 25, of Brighton East, for alleged contraventions of the Motor Car Traders Act 1986 (MCTA) and the Australian Consumer Law (Victoria).

The court imposed an interim injunction, with consent of the parties, restraining AusCarClub and Mr Cao and their employees, officers or agents from buying, selling, exchanging and/or offering to sell and/or exchange four or more cars in a 12-month period, unless licensed under the MCTA.

Consumer Affairs Victoria is also seeking final orders that AusCarClub and Mr Cao be restrained from engaging in unlicensed motor car trading.

Under Victorian law, a person may offer to sell a maximum of four cars without a motor car traders’ licence within a 12-month period.
