An estate agent’s representative has been reprimanded and fined $1000 for breaching the Estate Agents Act 1980 by having a beneficial interest in a property that he was commissioned to sell in 2008.
Nigel Henry James Pavilach, a representative for Elders Rural Services, was the sole director and shareholder of a company which was one of two that entered into a contract of sale for the house in December 2008.
The sale did not proceed after Elders Rural Services found out about Mr Pavilach’s interest in the purchase and notified the Business Licensing Authority.
Mr Pavilach was found to be in breach of the Act by being concerned or beneficially interested in the purchase of real estate without obtaining consent of the Director of Consumer Affairs Victoria.
