Melbourne Magistrate’s Court has imposed final injunctions against Dandy Performance Tyre & Auto Pty Ltd and its owners, restraining them from carrying on the business of trading in motor cars until licensed to do so under the Motor Car Traders Act 1986.
The Director of Consumer Affairs Victoria applied for injunctions against the business and owners Kirsty and Chris Naismith after becoming aware that they had advertised 78 different motor cars for sale on eBay and in The Age newspaper between May 2009 and March 2011, in contravention of the Motor Car Traders Act 1986.
The court ordered, on 30 June 2011, that the defendants publish a corrective advertisement in the Saturday Age before 30 July 2011 and pay costs of $1000.
